Terms of Use

These Terms cover your use of the website at www.pvsautomotive.com.au (Website) and anything you buy or use from it (Products).
Any extra term, representation, warranty or variation only binds us if PVS Automotive confirms it to you in writing, except where the Australian Consumer Law says otherwise.
Acceptance
Using the Website, and buying or using our Products, means you agree to these Terms and are bound by them. Our Products are specialised, so please read these Terms carefully before you place an order. If you don't agree with them, don't use the Website or our Products.
Revisions
We may update these Terms from time to time. An updated version takes effect the moment it's published on the Website. If you keep using the Website, you accept the revisions.
Online-only operation
PVS Automotive is an online-only business. There's no showroom access and we don't take walk-ins. You arrange every enquiry, order, warranty claim and return through the Website or by email.
General product disclaimer
Our Products are aftermarket components and may not suit every vehicle or every use case. We have no control over how a Product is installed, configured, maintained or used.
Where we state compliance for a Product, ADR-related claims for example, that statement covers the Product as supplied. Final compliance can depend on your vehicle configuration, the quality of the installation and the requirements in your state or territory. Some cases need certification by an engineer. You are responsible for confirming suitability, legality and compliance for your vehicle and your location before you buy and use a Product.
Aftermarket modifications may void factory warranties, affect insurance coverage or breach legal requirements. You use our Products at your own risk.
To the maximum extent permitted by law, PVS Automotive is not liable for any injury, death or property damage arising from vehicle operation, installation or Product use. This does not exclude any rights or remedies that cannot be excluded under the Australian Consumer Law.
Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Installation and third parties
Where a third party does the installation, we don't warrant workmanship, installation quality, vehicle suitability or labour outcomes. An installer we recommend isn't affiliated with PVS Automotive unless we've said so in writing.
Warranty
If a Product has a manufacturing defect under normal use, we'll repair or replace it at our discretion, subject to the Australian Consumer Law.
Warranty excludes normal wear and tear, cosmetic finish, paint, trim, consumables, labour, diagnostics, vehicle downtime and re-installation costs, except where required under the Australian Consumer Law.
Warranty is non-transferable and applies only to the original purchaser. It doesn't cover misuse, negligence, accident damage, water ingress (unless the Product is expressly rated for water exposure and used accordingly), unauthorised modifications, incorrect wiring, incorrect fitment selection, improper installation or use outside intended purpose.
Installer labour costs are not reimbursed under any circumstances, except where required by the Australian Consumer Law.
Warranty claims process
To start a warranty claim, contact us with your name, your order number, a description of the issue and photos or video where you can get them.
We inspect Products returned for assessment within a reasonable timeframe. Workload and part availability may delay that.
If the inspection confirms a covered fault, we'll arrange a remedy in line with the Australian Consumer Law. If we find no fault, or the issue isn't covered, labour, assessment and freight charges may apply.
Faulty or damaged products
If a Product arrives faulty or damaged, contact us as soon as you can with photos and your order number. You may need to return the item for inspection.
Where a fault is confirmed, we'll cover reasonable return shipping and provide a replacement, repair or refund as required under the Australian Consumer Law. If no fault is found, return shipping is not refunded.
We don't send a replacement before we've received and assessed the original item, unless we agree otherwise in writing. In urgent cases we may ask for a holding fee, refunded once the original item comes back and is assessed as faulty.
Incorrect orders
If our error means you get the wrong item, contact us with your order number and the details. We'll arrange an exchange or refund, subject to availability, and tell you how to return it. Where the error is ours, we cover reasonable return postage.
Returns and refunds
- Faulty, damaged, incorrect, or misdescribed items: your Australian Consumer Law rights apply, with no time limit set by us, no fee, and no condition about whether the item has been opened or fitted.
- Pre-order items we are waiting on stock for: cancel any time before dispatch for a full refund.
- Made-to-order items we build to your specification: cancel free of charge within 48 hours of placing your order, after which we complete and dispatch your order.
- Change of mind after delivery: 30 days on unused, unfitted items in their original packaging, approved by us in writing before you send anything back, for a full-value store credit or a refund. Sealed electronic items, including headunits, cameras and wireless control modules, must be returned unopened with the seal intact. Every return is inspected when it reaches us. We do not charge a restocking fee.
- Not eligible for change-of-mind return: sale and clearance items, delivered made-to-order items, gift cards, sealed electronics that have been opened, and anything used, fitted, or modified. Your Australian Consumer Law rights are unaffected in every case.
Those five points are the short version. Our Refund Policy sets out your options for returns, cancellations and refunds in full, and it's the authoritative version. Where anything on this page appears to conflict with it, the Refund Policy applies.
To request a return, contact us first for approval and return instructions. Items returned without approval may be refused and returned to sender at the sender's cost. This does not apply where you are exercising a right under the Australian Consumer Law.
Return addresses may change. Don't send an item to any warehouse or address unless we've given you the return address and approval in writing.
Exchanges
We'll exchange an unused, unfitted item in its original packaging within 30 days of delivery, subject to stock availability and to our approval in writing before you send anything back. Sealed electronic items must come back unopened with the seal intact, and every return is inspected when it reaches us. Return postage is at your expense and the original shipping charge is not refunded. Sale and clearance items, and made-to-order items once delivered, are not eligible for exchange on change of mind.
None of the above limits your rights under the Australian Consumer Law if an item is faulty, not as described, or does not do what it should.
Product development
Our Products are under continuous development and may be updated, improved or discontinued without notice. Product images may show fitted examples or optional accessories, and may not represent every included item unless we say so.
Ordering and payment
Your order is treated as an offer to buy, and we may decline it at our discretion: suspected fraud, a stock error, a pricing error or an inability to supply. You pay in full before we dispatch.
We may ask you for more information to verify your order. Once your order is processed and dispatched, confirmation and tracking details go to you by email.
Prices
Prices are listed in AUD and include GST unless we state otherwise. They're subject to change without notice.
Shipping
We ship using Australia Post, DHL or other trusted courier services. Tracking is provided where it's available. You are responsible for monitoring that tracking and making sure your order is received safely.
We only dispatch once full shipping payment has been received, unless a free shipping promotion applies.
Free shipping applies to eligible standard orders over $150 shipped within Australia. Oversized or freight-only items, international orders and orders under $150 are charged shipping calculated at checkout.
Product risk and title
Ownership passes to you once we've received payment and the order is dispatched. Risk passes on delivery.
Intellectual property
Everything on the Website is the property of PVS Automotive unless stated otherwise. You may use that content for personal, non-commercial purposes only. It must not be copied, modified, republished or redistributed without our written permission.
Website use and availability
The Website is provided on an "as is" basis. Maintenance and technical issues can cause downtime. We don't guarantee uninterrupted access and we're not liable for outages or errors, except where liability cannot be excluded under law.
Third party links
We're not responsible for the content, functionality, privacy practices or availability of any third-party website we link to.
Unsolicited contact
You must not use email addresses published on the Website for unsolicited communications, spam or unauthorised marketing. Impersonation, harassment or unlawful conduct through our Website is strictly prohibited.
Liability
To the maximum extent permitted by law, our liability is limited, at our discretion, to the repair, replacement or refund of the affected Products, except where the Australian Consumer Law requires additional remedies. We make no guarantee of Website uptime, accuracy or uninterrupted service.
Indemnity
You agree to indemnify PVS Automotive and its related entities, directors, officers, employees and contractors against any claims, losses or damages arising from your use of the Website or Products, except to the extent caused by our negligence or where liability cannot be excluded by law.
Governing law
These Terms are governed by the laws of New South Wales, Australia. All disputes are subject to the jurisdiction of NSW courts.
Where both parties agree, a dispute may be referred to arbitration under the Fast Track Arbitration Rules of the Institute of Arbitrators and Mediators Australia, seated in Sydney, Australia.
Currency conversion
By using the Website, you consent to third-party processing of your IP address for currency conversion. That may involve storing data in cookies.
